NRI Tax and Compliance Advisory

We help Non-Resident Indians manage their tax and regulatory obligations in India while living abroad. This includes filing Indian income tax returns, handling tax on the sale of property in India, claiming treaty relief, and moving money out of India in a compliant way.

Most of our NRI work is done remotely. Clients share documents by email, we prepare everything and coordinate with banks and buyers in India, and approvals happen online.

Who this is for

  • NRIs earning rent, interest, dividends or capital gains in India
  • NRIs selling a flat, house or plot in India
  • NRIs who want to repatriate funds from an NRO account
  • Indians moving abroad, or returning to India, who need to understand how their residential status affects their tax

What nri advisory covers

  • Residential status: working out whether you are resident, non-resident, or resident but not ordinarily resident for a year, which decides what income is taxable in India
  • NRI income tax returns: filing returns for rental income, interest, capital gains and other Indian income, and claiming refunds of excess TDS
  • DTAA relief: applying India’s tax treaties with your country of residence to avoid being taxed twice on the same income
  • Property sale by an NRI: computing capital gains, advising on exemptions, and coordinating with the buyer on TDS, which is deducted at higher rates when the seller is an NRI
  • Lower or nil TDS certificate: applying to the income tax department so the buyer deducts TDS on your actual tax liability instead of the full sale value
  • Repatriation: the remittance forms and Chartered Accountant certificate (commonly known as Form 15CA and Form 15CB) needed to move funds abroad from an NRO account
  • FEMA guidance: general guidance on NRE, NRO and FCNR accounts and on FEMA rules for property and investments held by NRIs

How we work

  1. A video or phone call to understand your residency, income and plans
  2. A document checklist shared by email
  3. Computation, filings and certificates prepared and shared for your approval
  4. Coordination with your bank, buyer or other parties in India
  5. Follow-up on refunds, notices and repatriation until the work is closed

Frequently asked questions

Do NRIs have to file an income tax return in India?

An NRI must file a return if their taxable income in India exceeds the basic exemption limit, and it is often worth filing even below that limit to claim a refund of TDS deducted by banks, tenants or buyers.

Why does the buyer deduct so much TDS when an NRI sells property?

When the seller is an NRI, the buyer must deduct TDS on the capital gain at the rates applicable to non-residents, and in practice this is often applied to a large part of the sale value. An NRI seller can apply for a lower or nil deduction certificate before the sale so that TDS matches the actual tax due.

How can I send money from my NRO account abroad?

Banks require a declaration from the remitter and, above certain limits, a certificate from a Chartered Accountant confirming that applicable taxes have been paid. We prepare and file these so the bank can process the remittance.

Can I claim credit in India for tax paid abroad, or vice versa?

India has tax treaties (DTAAs) with many countries that set out which country can tax an item of income and how credit for foreign tax is given. We apply the treaty with your country of residence to your Indian income.
